Following is a transcript of her two minute speech:&lt;br /&gt;&lt;br /&gt;&amp;nbsp;&amp;nbsp; &lt;span style="font-family: &amp;quot;Trebuchet MS&amp;quot;, sans-serif;"&gt;I am here on behalf of the Equal Rights Alliance supporting the Equal Rights Amendment. Only three states are needed to ratify the Equal Rights Amendment, and Florida should be one of them. &lt;/span&gt;&lt;br /&gt;&lt;span style="font-family: &amp;quot;Trebuchet MS&amp;quot;, sans-serif;"&gt;&amp;nbsp;&amp;nbsp; Women are guaranteed only one right under the United States Constitution, and that is the right to vote. This should be unacceptable to all Americans. &lt;/span&gt;&lt;br /&gt;&lt;span style="font-family: &amp;quot;Trebuchet MS&amp;quot;, sans-serif;"&gt;&amp;nbsp;&amp;nbsp; The 14th Amendment is often cited as giving women equal rights. It does not. It does not mention women at all but does specify that only men can vote. It is rather antiquated has been suggested that it be repealed.&amp;nbsp;&amp;nbsp; &lt;/span&gt;&lt;br /&gt;&lt;span style="font-family: &amp;quot;Trebuchet MS&amp;quot;, sans-serif;"&gt;&amp;nbsp;&amp;nbsp; American women enjoy many privileges today, but they are just that, privileges—not rights. The protest will begin on the corner of 9th and H Streets.&lt;br /&gt;&lt;br /&gt;One judge, Sacramento Family Court Judge Peter McBrien, has been a focus of community scrutiny for over a decade for his lack of judgment and destructive decisions. He destroyed ancient oak trees on a nature preserve to obtain a better view from his home which earned him the moniker of "Chainsaw" and resulted in a felony charge that he pled down to a misdemeanor. Additionally, he received a public reprimand from the Commission on Judicial Performance. He then became personally embroiled in the divorce case of Ulf Carlsson, and went far out of his way to destroy Mr. Carlsson by ensuring he was fired from his job. Judge McBrien committed numerous ethical violations along the way and earned another reprimand. Battered mothers report that he consistently places children with substantiated molesters, batterers, violent alcoholics, and drug addicts. Now, Judge McBrien failed to protect a toddler, who was then murdered. &lt;br /&gt;&lt;br /&gt;After a statewide AMBER Alert, two-year-old Madeline Layla Samaan-Fay was found near Placerville, CA in her father's vehicle. She and her father Mourad Samaan were both dead. &lt;br /&gt;&lt;br /&gt;Samaan had a pattern of not returning his daughter Madeline from visits and had told her mother that he was taking the child to Oregon against the court order. Prior to the toddler's death, Judge McBrien had refused to grant an ex parte request by Madeline's mother to order law enforcement to locate the father and child, and to place Samaan on supervised visits. Judge McBrien had a perfect opportunity to prevent this tragedy, but refused to assist the mother Marcia Fay, a California Deputy Attorney General, in locating and protecting her child. &lt;br /&gt;&lt;br /&gt;California judges have a pattern of not believing women and children, and are trained to minimize concerns of mothers, according to Judge DeAnn Salcide (Ret), founder of Judicial Action Watch Society. &lt;a href="http://www.facebook.com/pages/Judicial-Action-Watch-Society/219653241395520"&gt;http://www.facebook.com/pages/Judicial-Action-Watch-Society/219653241395520&lt;/a&gt; &lt;br /&gt;&lt;br /&gt;The United States has a pattern of not protecting women and children. The Inter-American Commission on Human Rights has sharply rebuked the United States for failing to protect women and children in the Gonzalez v. The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article. &lt;/span&gt;&lt;/span&gt;This amendment shall take effect two years after the date of ratification&lt;/em&gt;." &lt;/span&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;br /&gt;Barry Goldstein stated in his &lt;a href="http://timesupblog.blogspot.com/2011/07/extreme-custody-decisions-that-risk.html"&gt;Times&lt;/a&gt;&amp;nbsp; article that 40 states have determined that gender bias exists in their family court systems and are attempting to address the problem. An Equal Rights Amendment would not be a quick fix but would demand that&amp;nbsp;laws be passed to stop this illegal discrimination against women, and by extension against children,&amp;nbsp;in our family court systems. &lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;/div&gt;&lt;br /&gt;&lt;div style="text-align: justify;"&gt;The Warrior Dash is described as a 3.2 mile race from hell, a physical challenge to say the least,&amp;nbsp;and I am out of shape. 55 years old and out of shape. &lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;/div&gt;&lt;br /&gt;&lt;div style="text-align: justify;"&gt;But it is time to shape up. &lt;br /&gt;&lt;br /&gt;For all of us. &lt;br /&gt;&lt;br /&gt;Most of us have allowed &lt;a href="http://www.ratifyeraflorida.net/"&gt;ERA&lt;/a&gt;&amp;nbsp;to become what many would call an outdated issue. But it is not. It&amp;nbsp;was and remains a vitally important issue.&amp;nbsp;House Joint Resolution 47 was introduced on March 8, 2011 to remove the arbitrary time limit Congress imposed on the ratification of ERA. &lt;br /&gt;&lt;br /&gt;America is just three states away from ratifying an amendment that would guarantee Constitutional equality&amp;nbsp;for all of its citizens, not just its male citizens. &amp;nbsp;Please support this.&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;/div&gt;&lt;br /&gt;&lt;div style="text-align: justify;"&gt;By all means, sign the &lt;a href="http://www.change.org/petitions/support-gender-equality-pass-the-equal-right-amendment-three-state-strategy-hj-res-47"&gt;petition&lt;/a&gt;&amp;nbsp;, but don't stop there. Talk about it, blog about it. Link to this article on your websites. Write to your politicians. Find things to do that will draw media and public attention to, and hopefully garner support for, the Equal Rights Amendment. That is why I am running in the Warrior Dash, a physical challenge I am painfully discovering that I am in no shape for at this present time. But that can and will change! And so can our awareness of the need for ERA be heightened. And so can&amp;nbsp;our fitness to support&amp;nbsp;ERA be improved. Sacks case was accepted today at the US Supreme Court in Washington DC. Linda Marie Sacks, a Florida Mother was beaming, as she walked to hand deliver her 40 Petition for Certiorari, all wrapped in Red, White, and Blue American Flag ribbon. She said “This is an historic moment for all of America’s children and their “Protective Parents” who are not being protected by the “official avenues” who are supposed to protect them, judges, police and the Dept. of Family and Children. I am truly the all American Mom, and never did I ever imagine, that I could lose custody of my children for believing them and trying to protect. The Family Court system is giving pedophiles and batterers custody, and the safe, fit “protective parents” rights are terminated, or like me are placed on supervised visitation for years without a case plan or reunification plan”.&lt;br /&gt;&lt;br /&gt;She is a pro se litigant, and many years ago was quoted in the Momlogic.com article that she had her sights on the US Supreme Court if the family court did not return her children to her, as they were “legally kidnapped in April 2007 by Judge Shawn L. Briese. His ruling was REVERSED and REMANDED in 08/08 due to her constitutional rights to due process being violated, but this rare reversal provided no relief as Judge Briese refused to vacate the supervised visitation order or protect the minor children. &lt;br /&gt;&lt;br /&gt;The last time a case similar to this was presented was the Wendy Titelman case. Wendy wrote a book titled “A Mothers Journal” Let my Children Go! And it’s all about child placed in the custody of their abusive parent and the failure of Cobb County GA to protect her children. The book is included in the Sacks Cert Petition, on page 38 and it quotes Hon. Sol. Gothard when he says “the problems expressed in Wendy’s book are epidemic and widespread. &lt;br /&gt;&lt;br /&gt;These types of case and outcomes are noted by the DOJ, and OVW, as well as national advocates and Mothers all over the US.&lt;br /&gt;&lt;br /&gt;Sacks is only allowed to see her children for 2 hours a month at the local visitation center the 2nd and 4th Saturday for 1 hour. This has only amounted to 82 hours in 4years and 2months.&lt;br /&gt;&lt;br /&gt;Sacks, is a “squeaky clean”, mom, and before the April 2007 ruling by Judge Briese, she was her daughter’s primary care giver, and a loving caring Mother, as well as their class mom, soccer mom, car pool Mom, community volunteer, with no drugs, no alcohol, no abuse, no infidelity, and she lost physical custody of her children, and all she did was try to protect them. The trial court dismissed, ignored, and suppresses credible evidence of child sexual and physical abuse. &lt;br /&gt;&lt;br /&gt;The Fifth District Court of Appeals with Judge Evander, Judge Torphy and Judge Cohen, affirmed Judge Briese’s ruling and now this is an historical case being presented to the US Supreme Court. Her daughter’s teacher said “America better wake up, and you of all Mothers can lose custody, it can happen to anyone”. This crisis is noted by the Dept. of Justice.&lt;br /&gt;&lt;br /&gt;Eric Holder, the US Attorney General, at the DOJ, Dept. of Justice is quoted on page 37 of the Sacks Petition for Certiorari, as she notes his speech to the National Summit on Domestic Violence and Child Maltreatment and asks the question, “Why are battered mothers losing custody of their children to the courts or child protective services”. (http://justice.gov/ag/speeches/2009/ag-speech-090602.html).&lt;br /&gt;&lt;br /&gt;The Sacks case is a Justice for Children case and they advocate for children when “official avenues have failed to protect them”, judges, police, Department of Children and Family, (www.justiceforchildren.org)&lt;br /&gt;&lt;br /&gt;The Leadership Council, states that 58,000 are court-ordered to live with a sexually or physically abusive parent after a divorce in the U.S. and considers this a “public health crisis” for America’s children.(www.leadershipcouncil.org) and is also included on page 24.&lt;br /&gt;&lt;br /&gt;The CPPA, California Protective Parent Association, Connie Valentine and Karen Andersen, site case studies where a pattern is evident and have asked for Congressional Hearings to address this crisis.( www.protectiveparent.com) CPPA is on page 34 and 35 of the petition before the US Supreme Court.&lt;br /&gt;&lt;br /&gt;On March 2, 2011, Peter Jamison from the SF Weekly published an article “ILLEGAL GUARDIANS” When Judges Give Custody To Abusive Parents the Family Court System is broken. This article documents child sexual abuse cases and the identified perpetrator/ pedophile will get Sole Physical Custody of the minor child(ren), and the safe protective parent, will be restricted to supervised visitation or all contact will be terminated. It’s on page 24 and 25 of the Cert as well. (sf.weekly.com) This national case clearly shows how fit parent’s all over the U.S. are being be deprived of a relationship with their children, and this case exposes the national crisis for America’s children who are victims of child sexual abuse and or physical abuse, and the failure of family courts to protect them. &lt;br /&gt;&lt;br /&gt;This is a liberty right protected by the United States Constitution, for a parent-child relationship, but not protected by family courts or CPS all over the U.S.&lt;br /&gt;&lt;br /&gt;The National Organization for Women, NOW and the NOW Ad Hoc Law Committee are addressing this issue and in their Spring 2011, “and explore what can happen to a protective mother and her children when she does nothing more than to protect her children”, as quoted on page 36 of the Petition for Certiorari.&lt;br /&gt;&lt;br /&gt;The Petitioner, in the US Supreme Court case, Linda Marie Sacks, has been chosen as the “Poster Mother” of the Family Court Crisis, is interviewed for the article.(www.now.org) Click on the Family Law Spring Newsletter.&lt;br /&gt;&lt;br /&gt;O Magazine, by Oprah, 10/06 article by Jan Goodwin, “Please Daddy No”, Stopping Court Ordered Parental Child Sexual Abuse is quoted on page 37. Pierce states “the complicated issue of child custody presents another challenge involving the intersection of children and domestic violence. Day of Psychological Affiliates is quoted on page 5 as she stated “that it is this examiner’s opinion that this child is experiencing a significant mental health crisis, likely to pediatric bipolar, and therefore that negates any child sexual abuse”. Then she thwarted the investigation by the police department and DCF, Dept. of Children and Family. The child never had pediatric bipolar, but yet Dr. Day falsely labeled her, and provided false and misleading information to the court, and failed to protect the minor children.&lt;br /&gt;&lt;br /&gt;Linda Marie’s daughter in April 2007, said “Mommy fight for us, and do something every day to get us back, and don’t ever stop”. The purpose of this Act is to correct the trend in child custody and visitation cases wherein abused children, and children in homes where domestic violence exists, are placed by courts in the custody of the abusive or violent parent with the protective parent's custody, visitation, and contact with the child limited. &lt;br /&gt;&lt;br /&gt;For any State or public agency to receive any assistance under the provisions of §§5106, 5106a, 5106(c), or 5116, for fiscal year 2005 and any year thereafter, the State or the State in which the public agency applicant is situated must demonstrate that effective June 1, 2005, the following safeguards have been effected and implemented either by statutory enactment or court rule promulgated by the highest court in the State, with such enactment or court rule applicable statewide in every court having jurisdiction over child custody, parental visitation, parenting time, parenting plans, conservatorship of children, or any other issue involving the residence of a child and the contact between the child and his or her parents, incidental to or following separation or divorce, or in connection with a paternity case where the parents have were not married, to ensure that a parent who reasonably believes that his or her child is threatened by child abuse or domestic violence, perpetrated or allowed by the other parent is not punished by the court, or otherwise penalized by loss or limitation of custody, contact, or visitation with his or her child, or the child denied the custody and contact with that parent, for that parent's having such reasonable belief and for acting lawfully in accordance with such belief: &lt;br /&gt;&lt;br /&gt;(1) The prohibition against ex parte contacts with the judge hearing a child custody or child visitation case, as defined and controlled by state law, shall be specifically made applicable to child custody and child visitation cases, and shall, in addition to the general applicability of the prohibition, specifically include contacts between judges and guardians ad litem, minor’s counsel, custody evaluators, mental health professionals, mediators, screeners, and other such persons traditionally participating in child custody and visitation cases. &lt;br /&gt;&lt;br /&gt;(2) The roles of guardians ad litem, minors' counsel, and children's attorneys shall be limited to advocating for the wishes of the child at issue, and to participating in the court proceedings by presentation of evidence and argument in the same manner as a parent's attorney. Such persons shall be prohibited from substituting their own opinions and judgments for the wishes of the child, submitting evidence which would be excluded under the applicable evidence law if tendered by any other party, and in no case shall such person be deemed a quasi-judicial officer or be granted any fact-finding role. This provision shall not require a State to mandate an attorney to represent any child in custody or visitation cases, but shall only be interpreted to the limit the role of such person when provided. &lt;br /&gt;&lt;br /&gt;(3) Parents shall be provided full and timely access to all custody and mental health evaluations and reports which are to be considered in any custody or visitation proceeding, including all underlying data for such evaluations and reports, and shall be afforded the opportunity to depose prior to the trial and to cross examine at trial any and all mental health or custody evaluators who will testify in a custody or visitation proceeding. &lt;br /&gt;&lt;br /&gt;(4) No expert opinion or expert evidence attempting to discredit a parent's motivation for asserting that his or her child is abused or at risk of the effects of domestic violence committed by the other parent, or attempting to discredit a child's report of such abuse or violence, shall be allowed in a custody or visitation case unless that opinion or evidence is based on concepts and theories generally accepted by the scientific community and supported by credible and admissible evidence of facts which can be established independently of that expert's opinion. &lt;br /&gt;&lt;br /&gt;(5) Due process shall be afforded all parents in such custody and visitation cases, and such custody and visitation decisions removing custody, visitation, or contact from a parent who believes or asserts that his or her child is the victim of abuse or the effects of domestic violence perpetrated by the other parent shall not be made on the basis of written declarations or affidavits, or without adequate written advance notice and the opportunity to be heard as defined by state and federal constitutional law, even on a purportedly emergency basis, simply because that parent holds that belief. Furthermore, no such parent shall lose custody, visitation, or contact with a child based only on the opinion of a mental health professional that such parent is at risk of unlawfully fleeing with the child, unless credible and admissible evidence independent of the professional's opinion establishes that parent's plan or intent to flee. &lt;br /&gt;&lt;br /&gt;(6) Court sponsored mediation, conciliation, and intake screening programs shall not make recommendations or fact-finding reports to the judge regarding child custody, visitation, or contact unless all parties freely agree in advance of the transmittal of such report, and any parent shall have the right to contest the report. &lt;br /&gt;&lt;br /&gt;(7) No findings by any child protection agency shall be considered res judicata or collateral estoppel, and shall not be considered by the court unless all parents are afforded the opportunity to challenge any such determination. &lt;br /&gt;&lt;br /&gt;(8) Whenever child abuse or domestic violence is an issue in a child custody or visitation case, no mental health professional or child custody evaluator who lacks specialized training and experience in child abuse or domestic violence relevant to the specific allegations shall be appointed by the court to conduct any evaluation in the case. &lt;br /&gt;&lt;br /&gt;(9) Admissible evidence of child abuse or domestic violence shall be considered in any child custody or visitation case. &lt;br /&gt;&lt;br /&gt;(10) No parent shall be deprived of custody, visitation, or contact with his or her child, nor restricted in such custody, visitation, or contact, nor shall such a child be placed in foster care, simply because that parent reasonably believes that his or her child is the victim of child abuse or the effects of domestic violence, and acts lawfully in response to such reasonable belief to protect the child or to obtain treatment for the child. &lt;br /&gt;&lt;br /&gt;(11) No valid final order of protection or domestic violence restraining order rendered pursuant to the State's domestic violence or family violence protection statutes and filed with the State's protective order registry shall be violated by the award of custody or visitation to the perpetrator of domestic violence where such is prohibited by the domestic violence order of protection then in effect.&lt;div It is well documented that police are not called until the victim has been assaulted 5 to 6 times. And even then, it can be another 5 to 6 more assaults before he is called into court. Abusers are &lt;em&gt;not&lt;/em&gt; first offenders.” So says Judge Mike Brigner, and he ought to know. He informs conference attendees that “batterers are notorious for battering while out on bail or probation. He stressed that, “We need to take these dangerous offenders &lt;em&gt;seriously&lt;/em&gt;.”&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;Judge Brigner underscored the need for Judges and family court workers to be educated about the facts of domestic violence as so many judges continue to make decisions based on myth-understanding. One common misconception is that batterers are simply “good men” who are stressed out by divorce or separation. That could not be further from the truth. &lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;Brigner was adamant that batterers do not just “suddenly snap” and beat their wives. “No,” he says, “They are in complete control. Their anger is not mismanaged…it is very well managed and focused—towards their wives. These guys don’t &lt;em&gt;need&lt;/em&gt; anger management,” he said, “These guys could &lt;em&gt;teach&lt;/em&gt; anger management.”&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;After blasting the myths of the “good man” under stress and the non-existent need for anger management, Judge Brigner addressed the fact that batterers are notorious dead beat dads, “Batterers are twice as likely to be in arrears on child support than non-batterers.” Some other statistics provided by Judge Brigner (citing sources as he went) was that 30% of Batterers will physically or sexually abuse their children. More recent studies show up to 70% with the newest citing up to 80%. The numbers are even more staggering if the mother has been battered 50 or more times during the relationship, the likelihood of the children being physically abused or molested increases to 99%. &lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;Batterers are twice as likely to seek custody. Brigner says it is a “No Lose” situation for the abuser. Why? “Because they really don’t want the kids anyway.” While the mother stands to lose everything and often does, voluntarily giving up one thing after another in her negotiations with the abuser in efforts to protect her children. Joan Zorza, Esq., added that fear of losing her children often keeps a woman in an abusive situation much longer that she would choose to stay otherwise. Abusers use the children as weapons against the mother and property and pension rights (only a few of many examples) as bargaining chips.&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;Why do Judges typically hand down bad decisions in custody matters relating to domestic violence? Brigner says it is a combination of many things including the fact that most judges are overworked, and mistakenly believe that separation will end the violence. Some judges pigeonhole domestic violence as a criminal matter, falsely believing the criminal courts will handle the matter, therefore feel they should not have to deal with it. Some believe women are lying to them and are gender biased. Judges are misled by mental health professionals. In short, Judge Brigner says, “They are simply uninformed. This has been happening since "&lt;em&gt;Christ&lt;/em&gt;." Most of these women have been molested and raped and they all say the same thing, "Once your virginity has been stolen it doesn't matter, 10 men, 100 men, it is all the same." &lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;I am trying to understand what I am hearing, so I ask for clarification, "You mean that many of these women are not selling their bodies to support a drug habit or otherwise extravagant lifestyle?&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;"&lt;em&gt;None&lt;/em&gt; of them are." She was emphatic. “They are paying lawyer fees and court costs associated with protecting their children from abusers in custody hearings. They are just trying to keep their kids. They call me every day. I'm out on the streets working with these women, trying to help them. This is my story. This is my message. This is the seedy side of this issue that no one wants to deal with.”&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;Nicky, of course was not speaking of all prostitutes, nor of all mothers involved in prolonged custody battles, but rather about a&amp;nbsp;special group of those she is personally in contact with on a daily basis.&amp;nbsp;&amp;nbsp;I thought I had heard the worst at the 2008 Battered Mothers Custody Conference, but this on-the-side conversation with Nicky, attending the conference as an advocate,&amp;nbsp;did me in. The tears I thought I had dried two years ago in a resolved effort to &lt;em&gt;do&lt;/em&gt; something about the horror that is family court began flowing anew. &lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;Garland Waller, creator of the film, “Small Justice,” talked about the “Yuck Factor,” and why the media refuses to cover the national shame and scandal of child molestation and custody injustice. “Children being molested and raped by their fathers is simply not something anyone wants to hear about when they come home from a long day at work and listen to the news during supper.” The subject is simply too distasteful to the American pallet. So it is with “Nicky’s” story. Even those who understand the multifaceted “Yucky” abuser/molester custody issue don’t want to delve too deeply into the “seedy” side of it—at least not yet.&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;Do all mothers who have to come up with attorney’s fees and court costs in order to protect their children end up like the mothers Nicky is talking about? The vast majority do not, but does that mean we ignore the plight of what Nicky claims is becoming epidemic,. "Especially since the recession, thousands,” she says, “they are in every state, every city.” &lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;Wendy Murphy, attorney and author of the book, &lt;em&gt;And Justice for Some&lt;/em&gt;, shared a tragic story of a mother ordered by the court to surrender her two children into harm’s way, within easy reach of a father who was sexually molesting them. The day came to surrender the children, but the children did not show up. The police went to the mother’s home to forcibly take the children from her. They found bodies—both Mother and children were dead, victims of murder suicide. Who is guilty of murder here? The dead mother? or the judge who ordered her to do the unthinkable?&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;What will a desperate mother do to protect her children? &lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;Almost anything it seems.&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;Author, workshop leader, and activist, Lundy Bancroft says it is a cruel injustice to harm children by removing them from the home of a caring parent—either mother or father—but it is especially cruel when that parent is a mother.” He went on to say, “I am a great father. I adore my kids—but I am not a mother. I believe fathers should have 50% custody…as soon as they are taking 50% of the responsibility for the child, including 50% of the pregnancy…and 50% of the breast feeding.” &lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;Attorney Barry Goldstein, the first male to become involved with the annual Battered Mothers Custody Conference, talked about the broken system and gender bias which places a higher burden of proof on women than on men in custody proceedings. He cited two cases in which there was a “100% certainty” standard of evidence&amp;nbsp;given for mothers and a “50% probability” standard of evidence given for fathers. 15-20 different judges looked at these cases and saw nothing wrong with placing a “certainty” standard on the testimony of a woman and only a “probability” standard on the testimony of a man, yet, as Goldstein pointed out, “&lt;em&gt;This is a blatant rights violation&lt;/em&gt;.” &lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;&lt;br /&gt;&lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: justify;"&gt;&lt;span style="font-family: Arial, Helvetica, sans-serif;"&gt;Were these judges bribed? They make the fantastic , malicious, claim that millions of women are simply lying about the abuse in order to gain legal advantage in divorce and custody litigation. Their propaganda includes denouncing the booklet, 10 MYTHS ABOUT CUSTODY AND DOMESTIC VIOLENCE AND HOW TO COUNTER THEM published by the American Bar Association (ABA). The booklet educates attorneys in how to best serve the interests of clients who are victims of domestic violence.&lt;br /&gt;&lt;br /&gt;Media RADAR issued a special report debunking the booklet. Phyllis Schlafly made the false and absolutely ridiculous claim that representing clients who are victims of domestic violence is a cash cow for attorneys, and mimicking Media RADAR wrote that the booklet is full of false information aimed at enriching those in the legal profession. I not only disagree with them both, but I believe that neither Schlafly nor Media RADAR are the least bit interested in the real facts of the travesty that is taking place in this country as a result of domestic violence and custody litigation. Schlafy allows fear of radical feminism and an extremely narrow, fundamentalist, view of acceptable behavior for women, to color her entire perception of the issue.&lt;br /&gt;&lt;br /&gt;The following is a listing of the 10 Myths. Following that are a few facts correcting each myth.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Myths:&lt;/strong&gt;&lt;/div&gt;&lt;div align="justify"&gt;1.) Domestic violence is rare among custody litigants&lt;br /&gt;2.) ill effects of domestic violence on children are minimal and short term&lt;br /&gt;3.) Mothers frequently invent allegations of child sexual abuse in order to win custody&lt;br /&gt;4.) Domestic Violence has nothing to do with child abuse&lt;br /&gt;5.) Abusive fathers don't get custody6.) Fit mothers don't lose custody&lt;br /&gt;7.) Parental Alienation Syndrome is a scientifically sound phenomenon&lt;br /&gt;8.) Children are in less danger from a batterer once the parents separate&lt;br /&gt;9.) Parents who batter are mentally ill, or parents with no evidence of mental illness&lt;br /&gt;cannot be batters.&lt;br /&gt;10.) If a child demonstrates no fear or aversion to a parent, there is no reason not to award&lt;br /&gt;custody or unsupervised visitation&lt;br /&gt;&lt;br /&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;/div&gt;&lt;div align="justify"&gt;&lt;strong&gt;&lt;span style="font-size:130%;"&gt;Facts:&lt;/span&gt;&lt;/strong&gt;&lt;/div&gt;&lt;div align="justify"&gt;1.) According to the S. L. Keilitz National Center for State Courts, up to 50% of disputed custody cases involve domestic violence &lt;/div&gt;&lt;div align="justify"&gt;&lt;br /&gt;2.) Even without myriads of studies proving the ill effects of domestic violence on children, common sense dictates that domestic violence would have devastating effects on the healthy development of any child &lt;/div&gt;&lt;div align="justify"&gt;&lt;br /&gt;3.) There will always be those who lie and abuse the legal system in order to gain personal advantage, but evangelical political activist PHYLLIS SCHLAFLY in tandem with male supremist groups such as MEDIA RADAR (Respecting Accuracy in Domestic Violence Reporting), AMERICAN COALITION of FATHERS and CHILDREN (ACFC), men's advocates such as GLENN SACKS, and Abuser advocates such as DEAN TONG propogate the entirely unsubstantiated claim that millions of women lie about domestic violence and child sexual abuse in order to gain advantage in divorce/custody situations. The substantiated facts of the matter are these, that where false allegations are concerned, fathers are far more likely to make intentionally false accusations than mothers. The truth is that false allegations are no more common in divorce or custody disputes than at any other time. &lt;/div&gt;&lt;div align="justify"&gt;&lt;br /&gt;4.) Domestic violence is child abuse! Anger and violence are terrifying to anyone subjected to them. Can anyone argue that it is abusive to create such an environment in a home where children are being raised? In addition to common sense, studies have shown a strong correlation between domestic violence and child abuse. &lt;/div&gt;&lt;div align="justify"&gt;&lt;br /&gt;5.) Abusive fathers are far more likely to seek sole custody than non-abusive ones...and according to the American Judges Foundation, they are successful about 70% of the time. &lt;/div&gt;&lt;div align="justify"&gt;&lt;br /&gt;6.) Mothers who are victims of domestic violence often are depressed and suffer from Post Traumatic Stress Syndrome. As a result, they frequently present poorly at court and to custody evaluators and best interest attorneys. &lt;/div&gt;&lt;div align="justify"&gt;&lt;br /&gt;7.) The Americnl Psychological Association rejects PAS as lacking data support. The official position of the APA on PAS is that it is an unscientific concept. &lt;/div&gt;&lt;div align="justify"&gt;&lt;br /&gt;8.) Batterers are often more strongly motivated to control and abuse through the children after separation or divorce due to loss of other methods. &lt;/div&gt;&lt;div align="justify"&gt;&lt;br /&gt;9.) Psychological testing cannot distinguish between a batter and a non-batterer. The sad truth is that men who are batters, often test normally in psychological testing--a case in point would be Darren Mack who tested normally in psychological evaluations during divorce proceedings between him and his wife, Charlotte. He was administered these tests on advice from abuser advocate DEAN TONG, because during the proceedings his wife claimed to be frightened of him. It turns out Charlotte Mack’s fears were more than justified. One year later, Darren stabbed her to death. Mack is also charged with shooting the Judge who was handling their case—so much for the validity of tests purporting to reveal propensity for domestic in men. In truth, mental illness is found in only a minority of batterers. &lt;/div&gt;&lt;div align="justify"&gt;&lt;br /&gt;10.) Children of batterers or children who are being abused often show no outward fear or aversion to the offending parent. In fact, most of time they demonstrate just the opposite. These cases commonly involve domestic violence, child abuse, and substance abuse. Research indicates that that custody litigation can become a vehicle whereby batterers and child abusers attempt to extend or maintain their control and authority over their victims after separation. Although, research has not found a higher incidence of false allegations of child abuse and domestic violence in the context of custody/visitation, officers of the court tend to be unreasonably suspicious of such claims and that too often custody decisions are based on bad science, misinterpretation of fact, and evaluator bias. Fathers Rights organizations have introduced into official proceedings inappropriate psychological standards meant to produce false negatives in child sex abuse litigation for the benefit of male sex offender. No professional body has endorsed the Gardner-PAS (Parental Alienation Syndrome) methodology as an appropriate standard in any family law forum.&lt;br /&gt;&lt;br /&gt;B) In fact most professionals are highly critical of this and similar standards created to deliberately discredit female complaints about male family violence offenders, promoted by fathers rights allies such as Gardner, Underwager, Farrell and more recently Braver. These are contrived standards for protecting male offenders from the law, and allowing them to continue their unlawful injurious conduct.&lt;br /&gt;&lt;br /&gt;C) Fathers rights leaders engage in a campaign of public disinformation about family law matters including child support enforcement standards, custody litigation, maternal conduct in domestic disputes and other issues. They do this for the sole purpose of confusing the public and lawmakers to achieve for themselves recognition as a "special class" on the grounds of acutevictimization by society and the legal system. Fathers’ rights literature discredits some of their own most widely disseminated claims, such as (i) widespread and extreme legal system bias against men in custody disputes (ii) automatic disenfranchisement of their parental relationships, (iii) frequent patterns of false allegations of child abuse made deliberately by vengeful women, and (iv) routinely blaming of men for family violence acts they disavow that they did not commit, and (v) routine assessment on men of child support beyond their ability to pay.&lt;br /&gt;&lt;br /&gt;All of these above described fathers' claims can be easily discredited from a wide variety of published studies, some of which are sponsored by organizations closely associated with their own movement. The fact that the father rights spokespersons never mention these findings when making their outrageous and false public claims, are indicative of their lack of integrity. They have also obtained and misused federal program funds intended for the purpose of enforcing non-custodial parents visitations contact. Instead, these funds have been used to pay fathers rights attorneys and court professionals to compromise the litigation in favor of the fathers with the use of pro-offender psychological methods and other illicit and unethical tactics.&lt;br /&gt;&lt;br /&gt;D) However, the best determinate of the movements’ lack of integrity, is their claim of widespread injustice against fathers in the face of hundreds of complaints by fit and normal mothers who have lost custody and most visitation contact, without due process or cause other than "interference" with the father-child relationship. I, along with other advocacy leaders and public policy organizations have learned of and verified of hundred of such victimized mothers - many of which were associated with the father rights organizations and federal programs.&lt;br /&gt;&lt;br /&gt;Never have the fathers rights leaders made complaints similar to those made by these mothers. Never have they proffered an example case of a father who denied custody and NO NORMAL VISITATION CONTACT on grounds of intefering with the mother-child relationship. &lt;em&gt;While all know that termination of maternal contact with the children is a leading principal of Dr. Richard Gardner’s methodology&lt;/em&gt;, none from mothers’ community has ever advocatedpaternal termination on grounds of parental alienation or false allegations.&lt;br /&gt;&lt;br /&gt;But worse, all complaints from our community about these victimized mothers have resulted in an outpouring of hate mail, threats, and slut-or-nut crazy making. None from the fathers rights community have responded to one individual or collective complaint from the mothers community. NONE of the father rights leaders incorporate this factor when lobbying for public policy changes. All of their public policy advocacy has been based on the single notion that the system is biased against men and only men.&lt;br /&gt;&lt;br /&gt;Clearly the Fathers Rights movement has an out-for-yourselves agenda, with no regard to the concerns, rights or injury to others, especially those less equipped to do legal battle. While they claim victimization from false allegations and parental alienation by mothers, they coach their own male members to engage in these very illicit activities of false charges and parental alienation against mothers. Also, our group members have information that some fathers rights members engage in custody retaliation against mothers who refuse to comply with demands for abortion by rejecting fathers; in addition to some cases of affiliated professionals who have trafficked in child pornography.&lt;br /&gt;&lt;br /&gt;I will continue to contact and persuade public policy leaders and public official with my requests that Fathers Rights organizations be thoroughly investigated, and that the power of government be re-directed to stopping all the unethical and unlawful activities you have been engaging in - not the least of which is the proliferation of pro-pedophile/incest psychological material into the working methodologies of the courts and social services agencies of this country.&lt;br /&gt;&lt;br /&gt;In the meantime, I would like you to provide answer to the following questions:&lt;br /&gt;&lt;br /&gt;1) Since there appears to be confusion between "good" fathers' organizations who do not engage in the above described practices and those that do: please name all organization leaders, chapters and affiliated organizations working with or under the Fathers' Rights organization’s umbrella, keeping in mind several official reviews of Fatherhood movement  officials have cited that as many as 200 differently named groups all work together.&lt;br /&gt;&lt;br /&gt;2) Please detail your knowledge and reaction of Warren Farrell full multi-page 1977 Penthouse "Positive Incest" interview. What does he say when speaking before your organizations’(NCFC and CRC) events. Also can you comment on the connection Farrell has had with the Kinsey Institute.&lt;br /&gt;&lt;br /&gt;3) What is the Fatherhood's organizations’ (NCFC and CRC) affiliation with Dr. Ralph Underwager. Comment on your knowledge and reaction to Underwager’s Paedika interview. Detail how your organization refers cases to Underwager, and how many cases he has testified as an expert witness for child sex abuse or child custody evaluations. Are you aware of Underwager’s involvement in a California seminar in which he positively presented child pornography under the false guise of research.&lt;br /&gt;&lt;br /&gt;4) As all should know, Robert Hirschfeld has been permanently disbarred from the practice of law in Arizona. What does Bob Hirschfeld teach in his NCFC pro-se litigation courses? What does he advise men on how to handle their domestic litigation? Also, I would like a full copy of Hirschfeld’s disbarrment proceeding to better determine the legitimacy of the charges against him.&lt;br /&gt;&lt;br /&gt;5) And lastly, please do attempt to prove me wrong about item (D) from above, by citing one case of a father being restricted to supervised visitation on account of Parental Alienation for making false allegations.&lt;br /&gt;&lt;br /&gt;I think the most important change desired at this time from the organized fathers rights movement, is to respond to individual and collective complaints by mothers about system injustices against them, specifically, custody switches to proven and probably child abusers under the guise of protecting the child from the trauma of false allegation, and unjustified use of &lt;em&gt;supervised visitation on mothers on the grounds of parental alienation&lt;/em&gt;.
